Offer Eligibility and Redemption

• This offer is available only to companies within the month of June 2024.

• Clients must submit an initial request within June 2024 and have 30 days from the date of the request to sign the agreement. Failure to sign within this period will result in forfeiture of the offer.

• The offer can only be redeemed once per client.

• This offer is only available to end customers who will redeem the tests on systems they own and cannot be resold as a service elsewhere.

Service Scope and Additional Costs

• A penetration test under this offer includes either:

  • One web application test (up to 300 static pages or an equivalent amount of dynamic content).

  • One infrastructure test (up to 20 endpoints or an equivalent amount of containers/cloud resources).

• Any travel, accommodation, or additional expenses required to perform the test will be covered by the customer per test.

• Any changes to the scope of the tests after the agreement has been signed may incur additional charges and require a new agreement.

Test Redemption and Usage

• Once the agreement is signed, the customer has 365 days to redeem the 10 penetration tests.

• Any tests not used within the 365-day period will no longer be redeemable. No refunds will be provided for unused tests.

• Multiple tests can be combined. For example, testing a website with 600 static pages will count as 2 tests out of the 10 available.

• Tests must be booked in advance and are subject to the availability of Heretek testers.

4. Invoicing and Payment

• Customers will be invoiced once the agreement is signed.

• Payment will be due 30 days after an invoice has been delivered.

5. Company Rights and Liabilities

• Heretek reserves the right to terminate the offer early, refuse service without providing a reason, or cancel the offer at any time, in which case a full refund will be provided.

• Heretek shall not be liable for any indirect, incidental, special, or consequential damages arising out of or in connection with the services provided, including but not limited to, loss of profits, data, or use, even if advised of the possibility of such damages.

6. Confidentiality and Intellectual Property

• Heretek agrees to maintain the confidentiality of all client data and findings during and after the penetration tests. Any reports or data provided will be for the exclusive use of the client.

• All intellectual property rights in any reports, findings, or other materials produced during the course of the penetration tests shall remain the property of Heretek until full payment has been made by the client.

7. Compliance and Legal Matters

• Both parties agree to comply with all applicable laws and regulations in connection with the performance of the services.

• These Terms and Conditions shall be governed by and construed in accordance with the laws of the United Kingdom.

• Any disputes arising out of or in connection with this agreement shall be resolved through good faith negotiations between the parties. If such negotiations fail, the parties agree to submit to the exclusive jurisdiction of the courts of the United Kingdom.

8. Force Majeure

• Heretek shall not be liable for any failure or delay in performing its obligations where such failure or delay results from any cause beyond its reasonable control, including but not limited to, acts of God, war, terrorism, labor disputes, or governmental actions.

9. Entire Agreement

• These Terms and Conditions, together with the signed agreement, constitute the entire agreement between the parties and supersede all prior agreements and understandings, whether written or oral, relating to the subject matter herein.
